The North Carolina crime lab has been experiencing problems processing DWI blood tests because of the large amount that come in without enough resources to process them quick enough. In response to this problem the North Carolina legislation is trying to pass a bill which would allow the hospital that draws the blood to also test for BAC in the sample.

One such bill recently passed a vote in the House. The bill would permit a hospital who has a chemical analyst to test the BAC of a sample. Additionally if the person charged with DWI does not submit a written objection within a certain time frame the report from the hospital can be admitted into evidence without testimony from the analyst. The bill still must pass a vote in the Senate, but the Senate has similar bills up for proposal as well.
