A man in Raleigh has been charged with DWI after he hit a car head-on while traveling the wrong way down a one way street. The accident occurred Sunday. There were two people in the victim vehicle, the driver and his wife, who were both killed because of the accident. The intoxicated driver was also injured in the accident but survived.

Initially the driver was going to be charged with DWI and driving the wrong way on a dual lane highway. However the DA’s office has decided to also charge him with two counts of felony death by motor vehicle. The driver has three previous charges for DWI on his record. He plead guilty to a DWI charge in 2001, and charges in 2005 and 2006 were dismissed.

DWI Levels and Penalties:

Level 5 – Immediate driver’s license suspension for 30 days, with the possibility of limited driving privileges after 10 days; up to a $200 fine; the possibility of between 24 hours – 60 days in jail; and, possible substance abuse assessment.

Level 4 – Immediate license suspension for 30 days, with the possibility of limited driving privileges after 10 days; up to $500 fine; between 48 hours – 120 days in jail; and, substance abuse assessment if placed on probation.

Level 3 – Immediate license suspension for 30 days, with the possibility of limited driving privileges after 10 days; up to a $1000 fine; between 72 hours and 6 months in jail; and, substance abuse assessment if placed on probation.

Level 2 – Immediate license suspension for 30 days, with the possibility of limited driving privileges after 10 days; up to $2000 fine; between 7 days and 12 months in jail; and, substance abuse assessment if placed on probation.

Level 1 – Immediate license suspension for 30 days, with the possibility of limited driving privileges after 10 days; up to a $4000 fine; between 30 days and 24 months in jail; and, substance abuse assessment for those placed on probation.

Aggravated Level 1 – Most serious form of DWI offense.  This results in an immediate license suspension for 30 days, with the possibility of limited driving privileges after 10 days; up to a $10,000 fine; between 12 and 36 months in jail; monitored abstaining from alcohol for 4 months after prison release; substance abuse assessment.
