In recent DWI news in North Carolina there has been a lot of talk from law makers about making the DWI laws tougher. Some think they are as tough as they should be and others believe the law can be made stricter. One suggestion to toughen DWI law comes from State Representative Marcus Brandon. He is currently working on drafting a bill that would allow judges to review the entire record of someone charged with DWI.
Currently the way the law stands a judge will review the past ten years of someone’s record who is charged with DWI. DWI sentencing will vary depending upon how many DWI convictions someone has over the time span. For example someone who has four prior DWI convictions within a certain time frame can be sentenced at a higher level and found to be a habitual offender, which leads to much harsher punishment. If the new bill that is being drafted passes judges may be able to look at the complete record before imposing a sentence.
Only time will tell if this will come to fruition, but if it does it will result in a huge change in the way DWI charges are represented in court.
