Don’t drink and drive. This is the advice and phrase we hear consistently when it comes to consuming alcohol and operating a vehicle. It is common knowledge that consuming too much alcohol and driving can lead to disastrous results including not only penalties and fines but potentially loss of life or serious property damage. Most of us hear this advice and heed its warning because we know of the potential consequences such as being arrested by law enforcement. While we know we can be stopped by law enforcement and arrested for such an offense, what about the officers themselves should they choose to break the law by drinking and driving?
No one should drink and drive, but law enforcement officers should be held to a higher standard and not be allowed to have special treatment if they are caught drinking and driving. In an article I ran across a Waxhaw police officer was caught while suspected to be drinking and driving and was charged just as anyone else would be. It is unfortunate that an officer would break the law especially knowing the consequences of such behavior and being in a position of authority. However it is good to know that if an officer is caught in such a situation that other officers who have integrity and respect for the law will treat the law breaking officer just as they would anyone else who is caught breaking the law.

On the flip side, this article shows how EASY it is to be arrested for DWI. Our society is hyper-sensitive to DWI laws and the police have reacted. They even arrested one of their own, you know its serious. In addition, the BAC level is SO LOW, 0.08 is a very low amount. It is my opinion that people are no way near impairment at a BAC 0.08, however, as the law is written today, all the State has to prove is you had a BAC of 0.08 or greater to find you guilty.
